HELP!! need advice urgently

hi, my daughter is in year 10 at a 'prestigious' grammar school in melbourne.. she is gifted disabled, and subsequently the vast majority of teachers at her school perceive her as being "slow" despite her 142 IQ.. she also has been diagnosed as having adhd and both the paediatrician and psychologists sent recommendations to her school.. she has been at the school since grade 5 and to date NONE of the recommendations have been followed.. this afternoon i received a call from her school advising me that they believed that she wasn't capable of successfully completing vce or ib and that she should repeat year 10.. my daughter has been through hell and back with harassment and bullying from the kids at her school, to the point of her becoming depressed and feeling suicidal.. i informed the head of section that he can't call me 2 weeks before year 11 selections are in and inform me, especially considering that they never once have hinted.. he basically said that my daughter was lazy, unmotivated and had no desire to learn.. he also said that he felt that she wasn't "capable" of completing vce.. i reminded him that we'd all (school psychologist, school and ourselves) wanted her to work on her emotional needs and then worry about her academics.. she is more than capable of passing and thus i had little concern for her actual school work.. basically we have been at the school for 6 years and in that time she has suffered greatly emotionally.. they also never followed the recommendations from the medical professionals and when they did see her floundering, offered her nothing.. she does not want to leave.. what are my rights?? i do know that there might be some recourse through human rights and equal opportunity commission as the school due to her learning disability and her mental state and the school's lack of duty of care.. how should i approach the school and has anyone else been through this before?? thanks brooke

Brooke, I have not been through this as my kids are younger but i just wanted to express my sympathy for you and your daughter. I have also had disputes with a school before, it must be especially galling when you are paying for the privilege!! Principal? Letter? Copy to head of special education and the Board? It's very hard as I know. Please feel free to give a hint as to the school's location :-)

Ah, would I be inaccurate in thinking that one has to protect one's very spectacular VCE results?
